Industrial Color, Inc. (“Industrial Color”) and the counterparty agreeing to these terms (“Customer”) have entered into the Terms of Services for the provision of the Processor Services (as amended from time to time, the “TOS”).

This Privacy Policy (“Privacy Policy”) sets forth our policies and practices regarding the collection, use, transfer, and disclosure of certain information about you (“you” or “User”) arising out of your use of or access to the globaledit, Inc. (“globaledit,” “we,” “us,” and “our”) website located at https://www.globaledit.com/ (“Website”), and any other products, services, applications or software that link to or display this Privacy Policy (collectively, the “globaledit Products and Services,”). By accessing and using the globaledit Products and Services, you agree to the terms of this Privacy Policy and our Terms of Service located at www.globaledit.com. If you do not agree to the Privacy Policy and Terms of Service, please immediately stop accessing the globaledit Products and Services.


How globaledit May Collect and Use Information

We may collect Personally Identifiable Information (“Personal Information” or “PII”) about you that you provide to us (such as when you create an Account), through the globaledit Products and Services, or from your device when you use or access the globaledit.com Website and/or globaledit Products and Services. We may at www.globaledit.com collect Personal Information directly from you when you visit the “Website” (or “Site”), and only when you consent for us to do so. This may be through our web forms or registrations, and in connection with your inquiries and purchases you make. globaledit may also collect your Personal Information when you sign up to receive material about globaledit products and services. If you submit any Personal Information to globaledit relating to other people, you represent that you have the authority to do so and to permit us to use the information in accordance with globaledit’s Privacy Policy. 


We may also use Google Analytics. Google Analytics is a Google tool that we use for web analysis and allows us to understand how users engage with our Website. We may use the PII that we collect from you to provide you with information and services that you request and if applicable, the support and services offered through a product or program for which you registered through the Website. We may use collected information grouped together in anonymous form (“Aggregated Information”) to operate, maintain, enhance, and provide all of the features and information found on the globaledit Products and Services. We may also use the information that we collect to improve or develop products, services, or websites, conduct research or analysis, or comply with legal requirements. We or third parties engaged by us may store information that we collect from you. We may also anonymize or de-identify and aggregate data and information collected from Users through the globaledit Products and Services and use it for business or research purposes. 


You may decline to provide any PII to us while visiting and using the globaledit Products and Services. If you choose not to provide any PII, you may not be able to use the globaledit Products and Services or certain aspects of the globaledit Products and Services, Website, or App, and we will not be able to provide you with some of the features and functionality of the globaledit Products and Services. We or the globaledit Products and Services may provide links to other websites or resources maintained by third parties. You agree that we have no control over and are not responsible for those websites or resources or any information that you provide or may be collected by such third parties. We encourage you to review the privacy practices of those third parties. This Privacy Policy sets forth the privacy practices of globaledit for the globaledit Products and Services only.


Your Privacy Rights

Globaledit will ensure that you can exercise your rights pertaining to your PII, including rights as provided by various data protection laws. We therefore inform you that you are entitled:

  to have access to your Personal Information upon simple request – that is, you may receive a copy of such data (if requested), unless such data is made directly available to you, for instance within your personal account;

  to have access upon simple request, and free of charge, the categories and names of addresses of third parties that have received Personal Information for direct marketing purposes;

  to obtain a rectification of your Personal Information should it be inaccurate, incomplete or obsolete;

  to obtain the deletion of your Personal Information in the situations set forth by applicable data protection law (the ‘right to be forgotten’);

  to withdraw your consent to the data processing without affecting the lawfulness of processing, where your Personal Information has been collected and processed on the basis of your consent;

  to object to the processing of your Personal Information (where it has been collected and processed on the basis of legitimate interests of globaledit) in which case we may ask you to justify your request by explaining to us your particular situation;

  to request a limitation of the data processing in the situations set forth by applicable law;

  to have your Personal Information directly transferred by globaledit to a third-party processor of your choice (where technically feasible and when processing is based on your consent); and

  to non-discrimination, as defined under relevant law, in the Services or quality of Services you receive from us for exercising your rights. Under certain laws, you may also have the right to “opt-out” of having your Personal Information sold to a third party. This right to “opt-out” does not include the case of a merger, sale, financing, acquisition, or other transaction involving all or part of the globaledit Products and Services; in such instances, your information may still be involved in a transaction. For deletion, or ”right to be forgotten” requests, we will undertake a good faith effort to accommodate requests for access to or deletion of personal information. However, these requests may be subject to the evaluation of additional factors, including disproportionate burden or expense, or the risk to the rights, including the privacy rights, of others. Notice About Children’s Privacy

The globaledit Products and Services is not intended for children under the 13 years of age, and we do not accept registration from anyone under the age of 18 years old. If you are under the age of 13, please DO NOT USE the globaledit Products and Services. No personally identifiable information (as defined in the Children’s Online Privacy Protection Act of 1998 15 U.S.C. § 6501 (“COPPA”)) is purposefully or knowingly collected from children under the age of 13 by the globaledit Products and Services. In some instances, we may collect PII about children from and with the consent of his/her parent or guardian (e.g., for the provision of services, such as use of the globaledit Products and Services). In such instances, globaledit collects such information from the child’s parent or guardian directly, or directly from another authorized source. We will not seek to collect any information directly from any child. If a parent or guardian becomes aware that his or her child has provided us with PII, he or she should contact us as described in the “How to Contact globaledit” section below. We will take reasonable steps to delete such information from our database in accordance with applicable legal requirements.

To request the removal of information about a minor from this site, parents or guardians may submit a request to the email address below with the subject line “Removal of Minor Information.” Such requests must come from the minor’s parents or guardian; minors may not submit information to us via email.

California Residents

Globaledit has in place policies and procedures to facilitate the exercise of privacy rights available to California residents. If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to disclose the following information with respect to our collection, use, and disclosure of personal information. 

  • Your Privacy Rights Subject to certain limitations, you have the following rights under California law:

    • Right to Access: have access to your personal information upon simple request – that is, you may receive a copy of such information upon receipt of a verifiable request, along with other information related to the collection or processing.
    • Right to Disclosure of Direct Marketers: to have access upon simple request, and free of charge, the categories, and names/addresses of third parties that have received personal information for direct marketing purposes.  
    • Right to Information About Collecting, Selling, Sharing, or Disclosing Personal Information:  upon receipt of a verifiable request, you may obtain a list of:

  1. The specific pieces of your personal information Globaledit holds;
  2. The categories of personal information collected about you, sold to third parties, or disclosed to third parties for business purposes;
  3. The categories of personal information sold within the last 12 months;
  4. The categories of sources from which personal information is collected;
  5. The business or commercial purpose for collecting or selling personal information; and
  6. The categories of third parties with whom personal information is shared, sold, or disclosed for a business purpose.

  • Right to Opt-Out of the Sale of Personal Information: California residents have the right to opt-out of the sale of their personal information under certain circumstances.  As noted elsewhere, we do not sell your personal information.
  • Right to Deletion:  to obtain the deletion of your personal information in the situations set forth by applicable data protection law and upon receipt of a verifiable request.
  • Right to Non-Discrimination:  As defined under relevant law, you have a right to non-discrimination in the Services or quality of Services you receive from us for exercising your rights.
  • Right to Correct: California residents have the right to correct inaccurate pieces of information held by Globaledit. 

Please contact us utilizing the toll-free number or email address listed in the “Contact Us” Section below in relation to exercising these rights.  We will ask you to provide information about yourself so that we can verify your identity as part of this process. This information may include your name, email address, unique mattress identification tag number, and any other information necessary to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you. Once we have verified your identity, we will work to fulfill your request in a timely manner. Please note there may be some situations in which we are unable to fulfill your request, such as if we cannot find any information about you within our systems. Additionally, we may not be able to honor a deletion request in some situations, such as if your information is necessary to fulfill the Services you requested or meet a legal obligation. We will inform you whether we can fulfill your rights request.


We may ask for additional information if we have difficulty confirming your identity. We will not share your information or honor other requests in those situations in which we are unable to confirm a request for your information is a “verifiable request.”


Under California law a consumer can appoint an “authorized agent” to make certain verifiable requests upon their behalf, such as the right to know what information we collect about the consumer or to request deletion of the consumer’s information. An “authorized agent” may submit a request on behalf of a California resident who has authorized the agent to act on their behalf. Because the security and privacy of your information is paramount, we will ask that you identify such persons and directly confirm that such persons are authorized to act as your agent and exercise your applicable rights under California law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization. We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.

Under California law, you have the right to send us a request at the designated address listed below in the “Contact Us” section to receive the following information:

  • The categories of information we disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year;
  • The names and addresses of the third parties that received the information; and
  • If the nature of the third party’s business cannot be determined from their name, examples of the products or services marketed.

To make such a request, please provide sufficient information for us to determine if this applies to you, and attest to the fact that you are a California resident.  Please also provide a current California address for our response. You may make this request in writing to us at the address provided in the “Contact Us” Section.  Any such request must include “California Privacy Rights Direct Marketing Information Request” in the first line of the description, and include your name, street address, city, state, and ZIP code.  Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the address provided for this purpose below.

Colorado, Connecticut, Virginia, and Utah

If you are a resident of Colorado, Connecticut, Virginia, or Utah you have certain rights with respect to your Personal Data. Those rights include:

Right to Opt Out of Targeted Advertising You may ask us not to use your  personal information for purposes of targeting advertising to you based on your personal data obtained from your activity across different business, services, websites, etc.


Right to Opt-Out of the Sale of Personal Information: You have the right to opt-out of the sale of their personal information under certain circumstances.  As noted elsewhere, we do not sell your personal information.

To submit a request to exercise your access, deletion, or correction privacy rights, please provide sufficient information for us to determine if this applies to you, and attest to the fact that you are a  resident of the state in question.  Please also provide a current address in the state in question for our response. You may make this request in writing to us at the address provided in the “Contact Us” Section.  Any such request must include “Privacy Rights  Request” in the first line of the description, and include your name, street address, city, state, and ZIP code.  

Residents of Colorado, Connecticut and Virginia may appeal a refusal to take action on a request by contacting us at privacy@globaledit.com.


Nevada

If you are a resident of the State of Nevada, Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of the future sale of certain covered information that we have collected or will collect about you. To make such request please contact us at privacy@globaledit.com with proof of Nevada residency and include your name, street address, city, state, and ZIP code.


Canadian Residents

If you live in Canada, you have the following  rights:


Right to Access: You can ask us to: a) confirm that we have personal information about you, and b) provide you a copy of that information.


Right to Correct: You can ask us to  correct any inaccurate or incomplete personal information held by Globaledit.

You may make this request in writing to us at the address provided in the “Contact Us” Section. with the subject line “Canadian Privacy Rights Request”. 


European Residents

1. Information Access. As a Data Processor under the GDPR, globaledit is committed to responding to requests regarding the processing of Personal Data. To the extent technically possible, globaledit will, without undue delay, respond to:


a) Requests for Information. globaledit will assist with Data Subject requests to Data Controllers or requests sent directly to globaledit to obtain confirmation whether his/her Personal Data is being processed;

(b) Requests for Access to Data. globaledit will assist with identifying and providing a copy of Personal Data undergoing processing. A reasonable administrative fee may apply to the processing of such requests;

(c) Portability. Upon the valid request of a Data Subject, and subject to the other provisions of the Terms of Service, globaledit will assist with a request to transmit Personal Data which is the subject of globaledit processing to another Controller.

2.  Objection to Processing. In connection with valid Data Subject objections to processing related to direct marketing, or to objections to other specific legitimate interest or public interest grounds, globaledit will, without undue delay, evaluate whether continued processing on behalf of a Customer, Authorized User or you are appropriate, and may suspend processing until such determination is made and the request is resolved.

3.  Requests for Erasure. If Personal Data processed is no longer necessary for the purpose for which it was collected, or if Data Subject consent to processing is withdrawn, or if an objection is raised to the legitimate interests of a Data Controller (Customer, Authorized User, you) in processing the Personal Data, or if the data is otherwise unlawfully processed, globaledit will respond to requests without undue delay from Data Subjects to have their data erased. If technically not feasible to erase, globaledit will take the Personal Data offline, and/or will restrict access to the data to prevent further use of the data.

globaledit reserves the right to update or modify this Privacy Policy at any time. We encourage you to revisit this page frequently to stay aware of any changes. This Privacy Policy was last updated on the date listed below. If globaledit makes any material changes to this Privacy Policy, we will post a prominent notice on the globaledit Products and Services or send you an email at your last known email address. Your continued use of the globaledit Products and Services constitutes your agreement to this Privacy Policy.


Merger or Sale

In the event that we are acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information that we have collected from you or that you provided to us, as part of such merger, acquisition, sale, or other change of control.
